1. Who you are contracting with

Kids Brain Hub (the “Service”) is provided by Heros Afrika Consult Pty Ltd (“we”, “us”, “our”), trading as Kids Brain Hub. By creating an account, subscribing or using the Service you enter into an agreement with Heros Afrika Consult Pty Ltd on these terms. You can reach us at support@kidsbrainadventures.com.

2. Acceptance of these terms

By continuing to use the Service you agree to these terms. If you do not agree, please stop using the Service. We may update these terms; continued use after an update means you accept the revised terms.

3. Accounts, age and authority

Accounts are created and managed by a parent or legal guardian who is of legal age in their country. Children use the Service through a parent-created player profile. If you accept these terms on behalf of an organisation (for example a school), you confirm you have authority to bind it. You must give accurate information, keep it up to date, and keep your login details confidential — you are responsible for activity under your account.

4. What the Service provides

Kids Brain Hub is a daily learning app for children roughly aged 1–12: alphabet and number practice, riddles, facts, vocabulary and language activities in English, Spanish, Igbo, Hausa and Yoruba, plus streaks, tokens and a parent progress area. Some content is free; other content requires an active paid membership.

Spoken audio for some languages uses your browser’s built-in speech engine with phonetic spelling, which is an approximation and not a native-speaker recording.

5. Acceptable use

You must not misuse the Service. In particular you must not:

  • use it for anything unlawful, or in breach of any applicable law or regulation;
  • engage in fraud, spam, or misrepresentation;
  • infringe our intellectual property or that of anyone else;
  • interfere with the security or integrity of the Service — no malware, probing, penetration testing, scraping or automated harvesting;
  • reverse engineer, resell, redistribute, or circumvent technical or plan limits.

6. Licence and intellectual property

We grant you a limited, non-exclusive, non-transferable right to use the Service for personal family use within the plan you have selected. All software, content, illustrations, audio, documentation and branding in the Service remain the property of Heros Afrika Consult Pty Ltd or its licensors. Nothing in these terms transfers ownership to you.

7. Service level

We work hard to keep the Service available, but we do not guarantee that it will be uninterrupted, timely, secure or error-free. Features may change, and we may add, modify or remove content over time. To the fullest extent permitted by law we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

8. Payments, subscriptions and taxes

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

Payment, billing, applicable taxes, renewals, cancellations and refunds are governed by Paddle’s Buyer Terms. Memberships are offered weekly, monthly or yearly and renew automatically for the same period until cancelled. You may cancel at any time; if you cancel, paid access ends as described on our Refund Policy. Changing plans takes effect immediately with the price adjusted on a pro-rated basis.

9. Suspension and termination

We may suspend or terminate access to the Service where there is:

  • a material breach of these terms;
  • non-payment of fees due;
  • a security or fraud risk;
  • repeated or serious violations of our acceptable use rules.

Where reasonable and lawful we will give notice first. On termination your access ends; you may ask us for a copy of your account data within 30 days, after which it may be deleted.

10. Liability

To the fullest extent permitted by law, we are not liable for indirect, consequential or special damages, including loss of profits, data or goodwill. Our total aggregate liability is limited to the fees you paid in the 12 months before the claim. Nothing limits liability for fraud, death or personal injury caused by negligence, or anything else that cannot lawfully be excluded.

11. Indemnity

You agree to indemnify us against claims arising from your unlawful use of the Service, content you submit, or your breach of these terms.

12. General

These terms are governed by the laws of the Republic of South Africa, and the courts of South Africa have jurisdiction, unless mandatory local consumer law says otherwise. You may not assign your rights without our consent; we may assign ours in connection with a merger, acquisition or sale of assets. Neither party is liable for delays caused by events beyond reasonable control.
